Refund Policy

1. Introduction

Mick’s Gone Bush is committed to supplying quality products and addressing legitimate product concerns fairly and promptly. This Refund Policy explains our change-of-mind policy and the procedures that apply to returns, refunds, replacements, repairs and warranty claims.

Nothing in this Refund Policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

2. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Consumer guarantees apply automatically where the purchaser and transaction are covered by the Australian Consumer Law. These guarantees operate separately from, and may continue beyond, any manufacturer’s or supplier’s warranty period.

3. Major and Minor Product Problems

A major problem may arise where a product:

  • is unsafe;
  • is substantially or significantly different from its description, demonstration model or sample;
  • has one serious problem, or several smaller problems, that would have stopped a reasonable consumer from purchasing it had they known about the problems beforehand;
  • cannot be used for its normal purpose and cannot easily be repaired within a reasonable time; or
  • cannot be used for a particular purpose made known to Mick’s Gone Bush before purchase, where the customer reasonably relied on our advice, and the problem cannot easily be repaired within a reasonable time.

Where there is a major failure under the Australian Consumer Law, the customer may be entitled to reject the product and choose between a refund or replacement. The customer may alternatively choose to keep the product and seek compensation for any reduction in its value, where applicable.

A minor problem is generally a problem that can be repaired within a reasonable time. Where a problem is minor, Mick’s Gone Bush may choose to provide a repair, replacement or another remedy permitted under the Australian Consumer Law.

If a minor problem cannot be remedied, or is not remedied within a reasonable time, the customer may become entitled to additional remedies under the Australian Consumer Law.

4. Change-of-Mind Returns

Mick’s Gone Bush does not accept returns, exchanges, store credits or refunds where a customer has changed their mind.

A change-of-mind request includes circumstances where the customer:

  • no longer wants, requires or has a use for the product;
  • ordered the product by mistake;
  • ordered the incorrect product, model, size, specification, voltage, capacity or quantity;
  • selected a product that is incompatible with their vehicle, engine, equipment or intended application;
  • found the product available elsewhere at a lower price;
  • decided that the product was unsuitable for reasons not caused by a failure to meet a consumer guarantee; or
  • experienced a change in personal, financial or business circumstances.

Customers are responsible for checking product descriptions, dimensions, specifications, voltage, capacity, compatibility, fitment and suitability before placing an order.

Where a customer requests fitment or suitability assistance, the customer must provide complete and accurate vehicle, engine, equipment, model, serial number and application information.

Where incorrect or incomplete information supplied by the customer results in the wrong product being ordered, the return will be treated as a change-of-mind request and will not be accepted.

However, where Mick’s Gone Bush provides a specific written recommendation based on complete and accurate information supplied by the customer, and the customer reasonably relies on that recommendation, the customer’s rights under the Australian Consumer Law will continue to apply.

5. Making a Product Claim

Customers who believe that a product is faulty, unsafe, incorrectly supplied, materially different from its description or otherwise fails to meet an applicable consumer guarantee should contact Mick’s Gone Bush as soon as reasonably practicable.

There is no fixed 14-day or 24-hour deadline for making a claim under the Australian Consumer Law. The period during which consumer guarantees may apply will depend on the nature, price, quality, expected life and intended use of the product.

Customers should contact us before returning a product so that we can record the claim, confirm the correct return address and provide appropriate return or assessment instructions.

To assist us in assessing a claim, we may reasonably request:

  • proof of purchase;
  • the order number;
  • the product model, part number or serial number;
  • a clear description of the reported problem;
  • photographs or video showing the reported problem;
  • relevant diagnostic results or error codes; and
  • installation or application information where relevant to the reported problem.

A product does not need to be returned in its original packaging for a valid claim under the Australian Consumer Law. Customers should, however, package products safely and securely to prevent avoidable damage during return transport.

For products that appear to have been damaged during delivery, customers are encouraged to contact us promptly and retain the packaging so that we can investigate the delivery damage. This request does not impose a fixed time limit on any rights available under the Australian Consumer Law.

6. Product Assessment

Mick’s Gone Bush is entitled to assess a product before determining whether a repair, replacement, refund or other remedy is required.

Assessment may be undertaken by Mick’s Gone Bush, the manufacturer, an authorised service agent or another suitably qualified technician.

Consumer guarantee remedies may not be available where the reported problem was caused by:

  • misuse, abuse, neglect or abnormal use;
  • incorrect installation, wiring, configuration or commissioning;
  • installation or use contrary to the product instructions or specifications;
  • unauthorised modification, alteration, disassembly or attempted repair;
  • accident, impact, contamination, water ingress or environmental exposure not attributable to a product defect;
  • failure to perform required servicing or maintenance;
  • normal wear and tear;
  • use with incompatible equipment or components; or
  • a defect or limitation that was specifically disclosed to the customer before purchase.

These exclusions apply only to the extent that the customer’s actions, installation, use or other circumstances caused or contributed to the reported problem. They do not remove any consumer rights relating to an unrelated defect or failure.

If an assessment determines that the product does not have a fault or that the problem is not covered by the Australian Consumer Law or an applicable voluntary warranty, the customer may be responsible for reasonable assessment, collection and return-delivery costs. Any proposed assessment or collection charges will be disclosed before those costs are incurred where reasonably practicable.

7. Returning Products and Freight Costs

Products must be returned to the address provided by Mick’s Gone Bush. Customers must not send returns to a manufacturer, supplier, warehouse or other address unless instructed to do so by Mick’s Gone Bush.

For products that can be posted or easily returned, the customer may be required to arrange and initially pay for return delivery while the claim is being assessed.

If the product is confirmed to have a problem covered by the Australian Consumer Law, Mick’s Gone Bush will reimburse the customer for reasonable return-delivery costs that the customer has paid. Customers should retain freight and postage receipts.

Where a faulty product is large, heavy, installed or otherwise difficult or costly to return, Mick’s Gone Bush will arrange collection or otherwise meet its return-transport obligations as required by the Australian Consumer Law.

Mick’s Gone Bush is not responsible for unnecessary or excessive freight costs incurred without prior consultation where a reasonable lower-cost return method was available.

8. Manufacturer and Voluntary Warranties

Some products may include a manufacturer’s, distributor’s or supplier’s voluntary warranty. The availability, duration and conditions of these warranties vary between products and brands.

A manufacturer’s or voluntary warranty is additional to, and does not replace, restrict or limit, any rights available under the Australian Consumer Law.

Customers may contact Mick’s Gone Bush regarding a product problem even where a manufacturer’s warranty also applies. We may coordinate assessment or repair with the manufacturer, distributor or authorised service agent where appropriate.

Conditions contained in a voluntary warranty, including servicing, installation or maintenance requirements, apply only to that warranty and do not remove any rights that cannot lawfully be excluded under the Australian Consumer Law.

9. Refunds, Replacements and Repairs

The remedy available will depend on the circumstances, including whether the product has a major or minor problem and whether the Australian Consumer Law applies to the transaction.

No restocking fee, administration fee or similar deduction will be applied to a refund, replacement or repair that Mick’s Gone Bush is legally required to provide under the Australian Consumer Law.

Approved refunds will be returned to the original payment method unless another method is agreed with the customer or is reasonably required because the original payment method is no longer available.

Mick’s Gone Bush will process an approved refund as soon as reasonably practicable after the remedy has been confirmed. Most approved refunds will be submitted within 10 business days. Additional processing time imposed by banks, card providers or payment platforms is outside our control.

Store credit will not be substituted for a refund required under the Australian Consumer Law unless the customer voluntarily agrees to receive store credit.

10. Unauthorised Returns

Customers should obtain return instructions from Mick’s Gone Bush before sending a product.

Sending a product without first contacting us may delay assessment and may result in the product being delivered to an incorrect or unattended address. Mick’s Gone Bush may not reimburse avoidable freight, redirection or storage costs caused by an unauthorised or incorrectly addressed return.

This section does not prevent a customer from making a valid claim or exercising any right available under the Australian Consumer Law.
